General Terms and Conditions

§ 1 Scope
These General Terms and Conditions apply to all contracts between ProExpat Relocation Service & More, owner Lantijn Zijlstra, Eifgenweg 11, 40625 Düsseldorf, Germany (hereinafter “ProExpat”), and its clients (hereinafter “Client”) concerning the provision of relocation and consulting services. Deviating terms of the Client apply only if ProExpat has expressly agreed to them in writing.

§ 2 Services
ProExpat supports companies, international professionals and their families in preparing, carrying out and following up a move to Germany. The exact scope of services (e.g. home search, dealings with authorities, registrations, school and kindergarten search, settling-in support) results from the respective offer or order confirmation. ProExpat owes a diligent service, but not a specific outcome (e.g. the conclusion of a rental contract or the granting of a visa or residence permit); such decisions rest solely with the competent authorities or contracting parties.

§ 3 Conclusion of Contract
A contract is concluded by written order confirmation (including by e-mail) or by mutually agreed commencement of the services.

§ 4 Client's Duties to Cooperate
The Client shall provide ProExpat in good time with all information and documents required for the provision of the services, completely and truthfully. Delays attributable to late or incomplete cooperation shall not be at ProExpat's expense.

§ 5 Fees and Payment
The remuneration agreed in the offer applies, plus statutory VAT. Unless otherwise agreed, invoices are payable within 14 days without deduction. Expenses incurred (e.g. administrative fees, translations) are recharged based on actual costs where agreed.

§ 6 Appointments and Cancellation
Agreed appointments are binding. If the Client is unable to attend an appointment, it must be cancelled at least 24 hours in advance; otherwise, the expenses incurred may be invoiced.

§ 7 Liability
ProExpat is liable without limitation for intent and gross negligence as well as for injury to life, body and health. In cases of simple negligence, ProExpat is liable only for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract. No liability is assumed for the accuracy of information provided by third parties (e.g. authorities, landlords).

§ 8 Final Provisions
The law of the Federal Republic of Germany applies. If the Client is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Düsseldorf. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.

2. General Information on Data Processing
We treat your personal data confidentially and in accordance with the statutory data protection regulations (GDPR, German BDSG) and this privacy policy. As a rule, our website can be used without actively providing personal data.

3. Hosting and Server Log Files
Our website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA. When you visit the website, Vercel processes technically necessary data (e.g. IP address, date and time of access, page accessed, browser type) to provide the website securely and reliably. The legal basis is Art. 6 (1) (f) GDPR (legitimate interest in the secure provision of the website). Transfers to the USA are based on the EU Standard Contractual Clauses. Log data is automatically deleted after a short period.

4. Contact Form and E-mail Contact
If you contact us via the contact form or by e-mail, we process the data you provide (name, company if applicable, e-mail address, phone number if applicable, message) to handle your enquiry. The legal basis is Art. 6 (1) (b) GDPR (initiation or performance of a contract) or Art. 6 (1) (f) GDPR (legitimate interest in answering your enquiry). For the technical dispatch of form messages we use the service Resend (Resend, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA); transfers to the USA are based on the EU Standard Contractual Clauses. To protect against automated abuse (spam), the contact form uses Cloudflare Turnstile, a service provided by Cloudflare, Inc. (101 Townsend Street, San Francisco, CA 94107, USA). It checks whether the input comes from a human; for this purpose, technical information (including IP address and browser data) may be transmitted to Cloudflare. The legal basis is our legitimate interest in preventing spam (Art. 6 (1) (f) GDPR). Compared to conventional captcha services, Cloudflare Turnstile is particularly data-efficient. Your data will be deleted as soon as it is no longer required to process your enquiry and no statutory retention obligations apply.

5. External Content (Google Maps, YouTube)
To protect your data, Google Maps maps and YouTube videos are only loaded after you have actively started them by clicking (two-click solution). Only then is data (including your IP address) transferred to Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR; it can be revoked at any time with effect for the future by not reloading the content. YouTube videos are embedded in extended privacy mode (youtube-nocookie.com).

6. Cookies
This website does not use any tracking or marketing cookies. Only a technically necessary cookie is set to store your language selection (Section 25 (2) German TDDDG, Art. 6 (1) (f) GDPR).

7. SSL/TLS Encryption
For security reasons, this website uses SSL/TLS encryption. Data you transmit to us cannot be read by third parties.

8. Your Rights
You have the right to information (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR) and objection to processing (Art. 21 GDPR). You may revoke any consent given at any time with effect for the future. You also have the right to lodge a complaint with a data protection supervisory authority, e.g. the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (LDI NRW), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany.
